What is a Short Term Rental Application/Permit?
Any residential property that is rented out on a short-term basis- for a period of fewer than 30 days is considered to be a short-term rental. This includes homes that are listed for rent on Airbnb, VRBO, Vacation Rentals, HomeAway, and similar websites. A short-term rental is defined as the rental of an entire dwelling unit.

Online Applications for short-term rental registration must be submitted to Development Services, located at 101 S. Shady Shores, Rd, Shady Shores, TX 76208. Please note that incomplete applications will not be accepted by Development Services Staff. (Download and Print Application)
Once the application for a short-term rental permit has been submitted, download and complete the owner's portion of the inspection form. The Code Enforcement Officer will call to make an appointment to complete their portion in the owner's presence.

The 2020 Town of Shady Shores Ordinance Code # 3501-09-2021 includes regulations for short-term rentals. The new regulations require property owners offering short-term rentals to submit an application to the Town of Shady Shores.
Applications cost $1500.00, will be valid for a period of 1 year, and will require the host to meet certain minimum standards and restrictions as outlined in the code.
Once the yearly Short Term Rental Application is issued, a notice will be sent to all property owners within 200 feet of the rental property, including contact information, a 24-hour complaint hotline.
Short Term rentals are required to pay a hotel occupancy tax as determined by the State of Texas Comptroller's Office. You can find more information at Hotel Occupancy Tax (Texas.gov). Payment of the required hotel occupancy tax will be made directly to the Town of Shady Shores.
The regulations do not prohibit short-term rentals, but they do allow the Town of Shady Shores to monitor short-term rental properties and set certain standards in order to protect the integrity of the Town of Shady Shores neighborhoods and the safety of the community.
Reporting a Short Term Rental Complaint
Complaints regarding a short-term rental should be directed to the 24-hour emergency contact for the short-term rental.

Reporting Hotel Occupancy Tax Information
The Town of Shady Shores levies a 7% hotel occupancy tax, which by law must be used to promote the tourism and convention industry. This occupancy tax is calculated against the cost of a room in a hotel only if the room is ordinarily used for sleeping and does not include the cost of any food served or personal services rendered to the occupant. Reporting and payment of the 7% occupancy tax is made by the hotelier directly to the Town of Shady Shores. Each calendar month is a reporting period and taxes collected are due and payable on or before the 20th day of the month following the end of each calendar month.

Use of Hotel Tax Funds
The Hotel Occupancy Tax Fund was created under Town of Shady Shores Ordinance 351-09-21 and allows the Town of Shady Shores to record hotel tax collected and provide funding for activities and programs that are allowed under Ch. 351 and Ch. 156 of the Tax Code. Hotel tax revenue may be used for expenses directly enhancing and promoting tourism and the convention and hotel industry and must clearly fit into one of seven statutorily provided categories: Convention & visitor information centers, conventions, advertising, arts, historical preservation, promotion of sporting events, and the enhancement of existing sports facilities.
Report for Compliance with SB 1221, Texas Legislative Session 85(R)
Senate Bill 1221 from the 2017 Texas legislative session requires local governments to annually report their hotel occupancy tax rates and revenue amounts, including the percentage of revenue allocated for specific uses, from the preceding fiscal year. Shady Shores, TX – On September 13, 2021, after a public hearing, the Town of Shady Shores Town Council voted 3-0 to introduce for first reading a Short-Term Rental Ordinance. This ordinance includes input gathered since 2020 from public meetings, the Planning and Zoning Commission, residents, visitors, and interested parties.
After hearing from 4 residents during public comments, the council voted and adopted Ordinance # 351-09-2021.
The Short-Term Rental Ordinance would establish zoning regulations for Non-Hosted Accommodations. Currently, the Town has not issued any permits but has at least 2 prospective applicants. The Ordinance will take effect on November 1st. Any properties currently operating without a permit will have until January 1st to comply without citations.
The key provisions of the Short-Term Rental Ordinance #351-09-2021:
• Sets maximum occupancy requirements for daytime and nighttime.
• Sets minimum on-site parking requirements.
• Creates a Good Neighbor Brochure for renters and notifications of neighbors within 200 feet of the short-term rental.
• Creates a complaint/concerns resolution form on the Town of Shady Shores website for Code related concerns.
The first day to submit applications for a Short-Term Rental Permit would be November 1, 2021.
